These Terms govern your use of Avoria (the "Service"), operated by Eureka-Tech ("we", "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Avoria is a personal cycle, sleep, and wellness coach that generates daily briefs and tracks self-reported metrics. Avoria is not a medical device and does not provide medical advice, diagnosis, or treatment. Always consult a qualified professional for medical questions.
2. Eligibility & account
You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use Avoria. You are responsible for safeguarding your credentials and for activity under your account.
3. Acceptable use
You agree not to:
- Use the Service unlawfully, fraudulently, or for spam.
- Infringe intellectual-property or privacy rights of others.
- Probe, scan, or interfere with the security or integrity of the Service.
- Resell or redistribute the Service or its outputs without permission.
4. Intellectual property
The Service, including its software, design, branding, and documentation, is owned by Eureka-Tech and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for your personal, non-commercial use within your active plan. Content you input remains yours; you grant us a limited license to host and process it solely to operate the Service.
5. Subscriptions, payments & refunds
Avoria Pro is offered as a paid subscription. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders.
Payment, billing, taxes, renewals, and cancellation mechanics are governed by the Paddle Buyer Terms. Refunds are handled per our Refund Policy.
6. Service availability & warranties
The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free, or meet every requirement. To the fullest extent permitted by law, we disclaim all implied warranties.
7. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising from or related to the Service is limited to the fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.
8. Suspension & termination
We may suspend or terminate access to the Service if you materially breach these Terms, fail to pay, or repeatedly violate our policies. You may stop using the Service at any time.
9. Changes
We may update these Terms from time to time. Material changes will be surfaced in-app and reflected by the "Last updated" date above.
10. Governing law
These Terms are governed by the laws of the seller's place of establishment. Disputes will be resolved in the competent courts of that jurisdiction, unless mandatory consumer-protection law of your residence provides otherwise.
